1. About These Terms
These Terms & Conditions (“Terms”) govern services provided by Northeast Ohio Fleet Support LLC, doing business as Northeast Fleet Support (“Northeast Fleet Support,” “we,” “us,” or “our”), and use of our website.
By requesting, authorizing, scheduling, or accepting services from Northeast Fleet Support, you agree to these Terms. A separate written estimate, work order, fleet-service agreement, credit agreement, or other written agreement may contain additional terms. If a directly conflicting term appears in a separately signed written agreement, the signed agreement controls for that specific matter.
2. Services
Northeast Fleet Support provides mobile semi-trailer repair, fleet maintenance and support, preventive maintenance, inspections, diagnostics, parts sourcing, equipment-related services, and other services agreed upon with the customer.
The exact scope of work for a particular job is determined by the service request, inspection findings, estimate, work order, customer authorization, and circumstances encountered while performing the work.
We do not guarantee that every repair can be completed on-site or during the initial service visit. Additional parts, equipment, labor, towing, outside services, or a different repair location may sometimes be required.
3. Customer Authorization
The person requesting or authorizing service represents that they are the owner of the vehicle or equipment or otherwise have authority to authorize the requested work and associated charges.
Customers are responsible for providing accurate information about the vehicle, trailer, equipment, problem, location, access requirements, and any known conditions that may affect service.
By authorizing work, the customer authorizes Northeast Fleet Support to perform the agreed services and incur reasonable charges associated with that work.
4. Estimates and Additional Work
Any estimate is based on the information and conditions reasonably known when it is prepared. Actual conditions discovered during inspection, diagnosis, disassembly, or repair may affect the final cost or scope of work.
When practical, Northeast Fleet Support will obtain customer authorization before performing material work beyond the previously authorized scope.
Minor items reasonably necessary to safely or properly complete authorized work may be addressed as appropriate. Material additional repairs, parts, or services will generally require additional customer authorization.
5. Labor, Service Calls, Mileage, Parts, and Other Charges
Customers are responsible for applicable labor, service-call, mileage, parts, materials, shop supplies, disposal, diagnostic, after-hours, emergency, holiday, inspection, outside-service, tax, and other authorized charges.
Current rates may vary by service type, customer agreement, location, time of service, and other circumstances. Current pricing communicated in an estimate, work order, fleet agreement, invoice, or other written communication controls rather than any older pricing information.
Applicable taxes and government-imposed charges may be added where required.
6. Parts and Materials
Parts and materials supplied by Northeast Fleet Support may be subject to manufacturer or supplier availability, pricing, warranties, and return restrictions.
When a customer requests or supplies their own parts, Northeast Fleet Support does not warrant the quality, suitability, compatibility, condition, or performance of those parts.
Additional labor resulting from incorrect, defective, incompatible, or incomplete customer-supplied parts may be charged to the customer.
7. Payment Terms
Unless otherwise agreed in writing, private owner-operators and other customers without an approved commercial account are required to pay amounts due at the time services are completed or as otherwise communicated before service.
Approved commercial accounts may receive Net 15 or Net 30 payment terms according to the applicable written agreement or account approval.
Invoices are due according to the payment terms shown on the invoice or applicable written agreement.
Past-due balances may result in suspension of credit privileges, refusal of additional service, collection activity, and recovery of legally permitted collection costs or other remedies.
8. Scheduling, Cancellations, Rescheduling, and No-Shows
Customers should provide at least 24 hours’ notice when possible when cancelling or rescheduling an appointment.
If a technician is dispatched or arrives and the customer, vehicle, trailer, or equipment is unavailable; the location cannot reasonably be accessed; required access or information has not been provided; or the technician is otherwise unable to perform the scheduled service because of circumstances attributable to the customer, a no-show or unsuccessful-dispatch charge may apply.
That charge may include the applicable service-call charge plus a minimum of one hour of labor, along with other charges reasonably incurred for the dispatch.
9. Mobile Service and Worksite Conditions
Customers must provide a reasonably safe and accessible location for mobile service.
Northeast Fleet Support may decline, postpone, relocate, or discontinue work when conditions are unsafe, unlawful, inaccessible, unsuitable for the required repair, or otherwise create an unreasonable risk to persons or property.
Weather, traffic, road conditions, parts availability, emergencies, prior service calls, and other circumstances may affect arrival and completion times. Unless expressly agreed in writing, estimated arrival or completion times are not guarantees.
10. Inspections and Regulatory Compliance
Any inspection or related service reflects the condition of the vehicle or equipment at the time of inspection and within the scope of the inspection performed.
An inspection does not guarantee that a vehicle or component will remain free from defects or future failures.
Vehicle owners and operators remain responsible for maintaining their vehicles and equipment and complying with applicable federal, state, and local laws and regulations.
11. Warranties and Limitations
Northeast Fleet Support will perform authorized services using reasonable care consistent with the nature of the work.
Manufacturer or supplier warranties applicable to parts or materials are subject to the terms established by those manufacturers or suppliers.
Except as required by law or expressly provided in a written agreement, Northeast Fleet Support does not guarantee that a repaired component or vehicle will never experience a subsequent or unrelated failure.
To the extent permitted by applicable law, Northeast Fleet Support is not responsible for indirect, incidental, special, exemplary, or consequential damages arising from loss of use, lost loads, lost revenue, business interruption, delays, or similar losses.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
12. Customer Property and Existing Conditions
Northeast Fleet Support is not responsible for pre-existing damage, deterioration, corrosion, hidden defects, prior improper repairs, overloaded or improperly maintained equipment, or conditions not caused by our work.
Customers should remove or secure valuable or sensitive property before service when reasonably possible.
13. Third-Party Services and Suppliers
Certain work, parts, towing, specialized services, or other requirements may involve independent suppliers or service providers.
Third-party products and services may be subject to separate terms, warranties, limitations, and policies established by those providers.
14. Website Use
Information on the Northeast Fleet Support website is provided for general informational and service-request purposes.
Website content does not constitute a binding repair estimate, diagnosis, guarantee, or promise that a particular service can be performed until the service has been evaluated and accepted by Northeast Fleet Support.
Users may not misuse the website, interfere with its operation, attempt unauthorized access, or use it for unlawful purposes.
15. Privacy
Our collection and handling of personal information is described in the Northeast Fleet Support Privacy Policy available on our website.
16. Intellectual Property
Unless otherwise stated, the Northeast Fleet Support name, branding, logo, website content, graphics, and other original business materials are owned by or licensed to Northeast Ohio Fleet Support LLC and may not be reproduced or commercially used without permission except as allowed by law.
17. Force Majeure and Circumstances Beyond Our Control
Northeast Fleet Support is not responsible for delays or inability to perform caused by circumstances reasonably beyond our control, including severe weather, road closures, accidents, governmental actions, supply shortages, utility or communications failures, labor disruptions, natural disasters, or similar events.
18. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
Any dispute will be handled in an appropriate court having jurisdiction in Ohio, subject to any different dispute-resolution provision contained in a separately signed agreement and any rights that cannot legally be waived.
19. Changes to These Terms
We may update these Terms as our services, business practices, or legal obligations change. The current version will be posted on our website with an updated effective date.
Changes will apply prospectively unless applicable law permits or requires otherwise.
20. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
